Former banker Zhomart Ertaev will not be able to challenge the appellate court’s decision that revoked his release under amnesty, the Supreme Court of Kazakhstan stated.

According to the Court, under Article 484 of the Criminal Procedure Code, the appellate ruling is not subject to cassation review. The list of such non-appealable decisions is strictly defined by law.

The Court also noted that no petition for early release from Ertaev has been officially filed.

The Criminal Executive System Committee confirmed that Ertaev is serving his sentence in accordance with a court decision. Information about his place of detention is provided to close relatives, while personal case details remain confidential.

Background of the case

In 2020, Ertaev was sentenced to 11 years in prison for embezzling 144 billion tenge from Bank RBK. His sentence was later reduced to nine years.

He was subsequently convicted in another case involving loan fraud affecting Qazaq Banki and Eurasian Bank. Courts ordered the repayment of billions of tenge to the financial institutions.

In September 2025, Ertaev was released under an amnesty marking the 30th anniversary of Kazakhstan’s Constitution. However, the appellate court later identified procedural errors in calculating his sentence and revoked the amnesty decision, resulting in his return to custody.
